SM&B client Channel 4 wins unusual Terrorism Act production order case against Met Police

In a unique case, Channel 4 faced a production order claim from the Met Police for unused footage from “Brits Battling ISIS”, a Dispatches documentary first broadcast in 2015.

SM&B’s Media: Content & Disputes specialists represented Channel 4 and resisted the production order with Jonathan Caplan QC and Ben Silverstone. The case against the Defendant in the criminal proceedings collapsed today at the Old Bailey and, as a result, the case against Channel 4 was disposed of in Channel 4’s favour. This has been widely reported today, including in the Guardian (https://www.theguardian.com/uk-news/2018/jul/31/james-matthews-who-joined-kurdish-forces-to-fight-isis-not-guilty) and the Mirror (https://www.mirror.co.uk/news/uk-news/breaking-ex-british-soldier-accused-13007747).
