Kenyan Supreme Court declares mandatory death penalty unconstitutional

The Supreme Court of Kenya has ruled the mandatory death penalty is unconstitutional in a landmark decision delivered today. The Death Penalty Project, appeared as amicus curiae in this historic case which will affect thousands of prisoners in Kenya.

Prior to the judgment, death sentences would automatically be imposed on any person convicted of murder or robbery with violence. The decision means judges will now be given the power to decide whether or not the death penalty should be applied.
